How long does it take to make a personal injury claim?

The average length of a personal injury claim is 6-8 months. However, if your claim is particularly straightforward, it may take less than that as there may be less evidence to gather and fewer negotiations over the settlement. In other claims, it may take longer than 6-8 months if accident evidence takes longer to gather, there is a dispute over liability, or it is difficult for a medical expert to issue a prognosis due to ongoing injury.

One of the main factors in determining the length of time it takes for a personal injury claim to settle depends on your recovery. We want to ensure you get complete compensation for your injuries, and if we tried to get settlement within a month or two, the full extent of your recovery may not be known and the amount of compensation underestimated.

Instead, after 3-4 months you will meet with a medical expert at your local hospital or surgery, and they will make an assessment of your progress and any ongoing problems. At this point should the extent of your injuries and of the effect they will have on your life still be unknown, further medical assessment will be arranged until the full impact of the accident is known and the appropriate amount of compensation can be negotiated.
